On today's ruling by the Federal Constitutional Court on the promotion of
Desiderius Erasmus Foundation, explains chairwoman Erika Steinbach:
„The ruling by the Federal Constitutional Court is a resounding slap in the face for the German Parliament and the Federal Government!
In its ruling today, the Federal Constitutional Court found that the failure to take DES into account has been unconstitutional and unjustified since 2019.
This means that DES now has the opportunity to claim state funding retroactively. We will submit the relevant applications to the BMI and the Federal Administrative Office and, of course, also incorporate the ruling of the Federal Constitutional Court into the ongoing proceedings before the Higher Administrative Court in Münster.
At the same time, the Federal Constitutional Court has made it clear and instructed the legislature to pass a separate law governing the allocation of funds to political foundations. In any case, this must be based on the earlier rulings of the Federal Constitutional Court.
We expressly welcome this. It will put an end to arbitrariness and backroom deals with the other foundations.“
