Newsletter No. 32 – 31 March 2025: On the Constitutional Court ruling of 27 March 2025

Dear members, friends and supporters of our foundation, In 2023, the Federal Constitutional Court (BVerfG) ruled that the Federal Government and the Bundestag had unlawfully denied the Desiderius Erasmus Foundation funds for 2019. The court clearly stated that the AfD's right to equal opportunities in political competition under Article 21 of the Basic Law had been violated. Accordingly, we have called on the Federal Government to pay us the funds that were unlawfully withheld. At the time, the ruling noted that the court assumed that the Federal Government would act accordingly.

Dear members, friends and supporters of our foundation,

In 2023, the Federal Constitutional Court (BVerfG) ruled that the Federal Government and the Bundestag had unlawfully denied the Desiderius Erasmus Foundation funding for 2019. The court clearly stated that the AfD's right to equal opportunities in political competition under Article 21 of the Basic Law had been violated.

Accordingly, we have called on the federal government to pay the funds that were unlawfully withheld from us. At the time, the ruling noted that the court assumed that the federal government would act accordingly.

To this day, however, the Federal Government refuses to pay our foundation the global subsidies that were withheld from us.
Against this backdrop, the AfD has again approached the Federal Constitutional Court with a request for a retrospective enforcement order. In a decision dated 19 February 2025, which was only published on 27 March 2025, the request was rejected.

This is how much money the other foundations receive:

In the 20th legislative period (until February 2025), the other foundations received the following in just three and a half years:
                  – the SPD-affiliated Friedrich Ebert Foundation around 1.4 billion euros
                  – the CDU-affiliated Konrad Adenauer Foundation around 870 million euros
                  – the Heinrich Böll Foundation, which is close to the Green Party 430 million euros
                  – the Friedrich Naumann Foundation, which is affiliated with the FDP 330 million euros
                  – the Rosa Luxemburg Foundation, which is close to the Left Party 320 million euros
                  – the CSU-affiliated Hanns Seidel Foundation around 260 million euros

The Federal Republic of Germany has been experiencing a serious constitutional crisis for years. This has been vividly described as the „rule of injustice“. In this situation, the Federal Constitutional Court should actually play a key role. Unfortunately, in this worrying situation, which is damaging to democracy, it is withdrawing from the effective control of the constitutionality of sovereign actions. This has been demonstrated by the decisions to reactivate the old Bundestag in order to abolish the debt brake.

Over the past decade, the federal government has spent tens of billions of our tax money on so-called non-governmental organisations, in addition to political foundations. These are predominantly left-wing front organisations that articulate what the federal government itself is not allowed to do: namely, to fight the opposition – in other words, the AfD and, with it, the DES.
